The Supreme Court has strongly reprimanded the Assam government for filing a “defective” affidavit regarding the detention of 270 illegal immigrants at the Matia Transit Centre. The apex court raised concerns over the lack of clarity in the affidavit, which failed to explain why the detainees, who were declared foreigners, are still being held without the initiation of deportation procedures.
The case centers around a petition seeking direction for the Assam government not to detain individuals declared foreigners by the tribunal unless it can provide evidence of a possible deportation in the near future. The petition further questioned the state’s continued detainment of these individuals despite their legal status as foreigners.
In a hearing regarding the deportation of these individuals and the facilities at Assam’s detention centres, the Supreme Court directed the Assam Chief Secretary to appear via video conferencing during the next hearing. The top court also expressed its dissatisfaction with the Assam government’s handling of the situation, particularly its failure to take action regarding the deportation process.
Previously, on December 9, the Supreme Court had granted the Assam government a six-week period to submit a detailed affidavit outlining why the 270 individuals are still being detained at the Matia Transit Centre. Despite this time frame, the Court was displeased by the lack of progress in initiating deportation.
While the Assam government had requested that the affidavit remain confidential due to the personal details of the detainees, the Supreme Court instructed the Assam State Legal Services Authority to conduct surprise inspections at the Matia detention centre to ensure detainees are being provided with basic necessities.
The government’s counsel argued that the detainees were held only after being declared foreigners by the Foreigners Tribunals and outlined the procedures for deporting illegal migrants. However, the Court raised serious concerns about why detentions were ongoing without any action being taken on the deportation process.
The case remains under scrutiny, and the Assam government has been asked to explain why the deportation process has not yet been initiated.
